What a Texas notary does
- Verifies the identity of the person signing.
- Witnesses the signature.
- Confirms the signer appeared willingly and appeared to understand what they were signing.
- Administers oaths, for a jurat.
- Applies a seal and records the act.
What a notary does not do
A notary in the United States is not an attorney and does not have the authority a notario público has in many Latin American countries.
- Cannot give legal advice.
- Cannot prepare legal documents for you or tell you which document you need.
- Cannot verify that a document is true or that its contents are accurate.
- Cannot represent you in any proceeding.
- Cannot certify a copy of certain vital records, which come from the issuing agency.
Notarization proves who signed, not that the document is correct or that it will accomplish what you want. If you need advice about what a document does, that is an attorney's role.
What to bring
- Valid, unexpired photo identification.
- The complete document, unsigned. Do not sign before you arrive.
- Every signer, present in person.
- Any witnesses the document requires.
